Terms of Service
These Terms of Service (“Terms”) govern access to and use of Digi Mobile Studio and related services provided by Digielicit (“Digi,” “we,” “us,” or “our”), including the Shopify app, Mobile Studio configuration tools, branded mobile app access, and cloud publish infrastructure (together, the “Services”).
By installing Digi Mobile Studio, signing an order form, or otherwise using the Services, you (“Merchant,” “you”) agree to these Terms. If you are accepting on behalf of a company, you represent that you have authority to bind that company.
1. Who we are
Digi Mobile Studio is a commercial product operated by Digielicit. The production Partners App URL and related web presence are hosted at app-studio.in. Mobile Studio administration runs as a Shopify-hosted app extension. These Terms do not create a partnership, joint venture, or employment relationship.
2. Services
Subject to your plan and any written order form, Digi provides:
- Mobile Studio — configuration of branding, layout sections, offers, and supported integration toggles in Shopify Admin;
- Branded app access — use of a Digi-built mobile application identity connected to your Shopify store;
- Cloud configuration — hosting and delivery of published store configuration via Digi’s cloud path (including Supabase-backed components).
Base plans do not include delivery of mobile application source code. Source code license or share is available only as a separate paid add-on under a written agreement. Digi retains all right, title, and interest in the underlying product, platform, and software except for merchant-owned content you provide (logos, images, copy) and your Shopify store data.
3. Shopify dependency
The Services depend on Shopify’s platform, APIs, Admin, Billing (where used), and your Shopify store remaining in good standing. Digi is not Shopify and is not responsible for Shopify outages, API changes, policy enforcement, store suspensions, or third-party Shopify apps. Features that rely on Shopify may change when Shopify changes its products.
4. Plans, term, and fees
- Commercial packages typically include a one-time setup fee and a recurring subscription (Starter, Growth, or Enterprise, or as stated on your order form).
- Unless otherwise agreed in writing, the minimum term is twelve (12) months.
- App install fees (setup + plan) are billed via Shopify Billing in Digi Mobile Studio.
- Add-on fees may be billed via invoice / other methods when the work is not tied to the app install.
- Amounts and inclusions are described on our Pricing page and in your order form. In case of conflict, the signed order form controls.
- You are responsible for applicable taxes, App Store / Play Console fees, and developer account costs unless Digi expressly agrees otherwise in writing.

5. Merchant responsibilities
- Provide accurate store information, brand assets, and timely feedback for setup.
- Comply with Shopify’s terms, Apple App Store / Google Play policies, and applicable law (including advertising, privacy, and consumer rules for your markets).
- Keep credentials secure; do not misuse Admin tokens, Studio publish access, or cloud endpoints.
- Ensure content you upload or publish does not infringe third-party rights.
6. Acceptable use
You may not use the Services to: violate law; distribute malware; scrape or attack Digi or Shopify systems; resell access without authorization; reverse engineer the product except where prohibited by law from restricting such activity; or attempt to obtain source code outside a signed source-code agreement.
7. Beta features
Some features, including Makeup Try On, may be offered as beta or preview. Beta features are provided as-is, may change or be withdrawn, and are not a commitment that a full experience will ship on any date. “Coming soon” statements are informational only.
8. Support and customization
Support levels follow your plan. Included setup covers the minimum branding/config package described commercially. Advanced customization, new native modules, deep Try On pipelines beyond beta, and similar work require a separate quote or statement of work.
9. Confidentiality
Each party must protect the other’s non-public business and technical information with reasonable care and use it only to perform under these Terms or your order form.
10. Privacy
Our handling of personal data is described in the Privacy Policy. You remain the controller of your customer and store data; Digi processes certain data as needed to provide the Services.
11. Disclaimers
EXCEPT AS EXPRESSLY STATED IN A SIGNED AGREEMENT, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DIGI DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW. Digi does not warrant uninterrupted or error-free operation, or that the Services will meet every commercial outcome you expect.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL. DIGI’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE FEES YOU PAID TO DIGI FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. These limits apply regardless of theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in those cases, Digi’s liability is limited to the fullest extent allowed.
13. Indemnity
You will defend and indemnify Digi against claims arising from your store content, your misuse of the Services, your violation of law or third-party rights, or your failure to comply with App Store / Play / Shopify rules — except to the extent caused by Digi’s willful misconduct.
14. Suspension and termination
Digi may suspend or terminate access for non-payment, material breach, legal risk, or abuse. On termination, your right to use Digi-hosted configuration and branded app access under the subscription ends, subject to any transition Digi agrees to in writing. Provisions that by nature should survive (fees owed, IP, liability limits, confidentiality) survive termination.
15. Changes
We may update these Terms by posting a revised version on this site with an updated “Last updated” date. Material changes for existing contracted merchants will be communicated as required by your order form or applicable law. Continued use after the effective date may constitute acceptance where permitted.
